EU AI Act & AI Marketing Transparency

What applies from August 2026
Article 50 transparency obligations generally apply from 2 August 2026. A limited grace period until 2 December 2026 applies to the Article 50(2) marking and detection duty for certain systems placed on the market before 2 August 2026; it is not a blanket postponement for every organisation.
The European Commission provides official guidance and an Article 50 FAQ. Always use the current consolidated text and sector-specific advice.
Practical marketing checks
Identify whether your organisation is acting as a provider or deployer, whether people are knowingly interacting with an AI system, and whether synthetic image, audio, video or public-interest text creates disclosure obligations. Audit how those disclosures reach users.
- Inventory AI systems and the content they produce.
- Record provider/deployer roles and relevant use cases.
- Review chatbot notices and synthetic-media disclosures.
- Establish human review and escalation ownership.
- Ask qualified legal counsel to determine obligations where needed.
What an agency should not promise
A marketing agency should not claim to deliver legal certification or blanket compliance based on a web checklist. The responsible output is a documented operational review and a referral to legal specialists for interpretation.
The text here is general information, not legal advice. Official sources include the EU AI Act Service Desk and the European Commission.
Build transparency into marketing operations
Connect disclosure checks to the creative brief, campaign approval and records of what was published. Tie this to content production and automated workflows rather than leaving it as a footer-only disclaimer.
Frequently asked questions
Did all AI-generated marketing content require a label from August 2026?
No. Article 50 contains specific obligations, contexts and exceptions. The duty depends on the role, the system and the type and purpose of content.
Can an agency certify EU AI Act compliance?
Not merely by providing an operational marketing review. Legal compliance conclusions require appropriate expertise and facts.
